These deeds are to be read in conjunction with other deeds on these pages of Lancashire, Westmoreland and Cumbria, as there is a cross-over. There are a great many deeds Lancashire still to be up-loaded, and once that has been done it is hoped to combine them all into one file.The spelling, for the most part, has not been altered. They are arranged chronologically.

Quitclaim... preamble reciting that Richard Eccleston of Cartmell, in the county of Lancaster, yeoman, servant to Hugh Dicconsinn of Ullerthwaite in the said county, gentleman, who had bought all the estate, tythe and tennantright of one John Mastonn and Margaret his wife of and in all that messuage and tenement and 2 burgages in Flookburgh, late in the tenure of William Caton or his assigns, and now in the tenure of Richard Culeston (?)and the said William Caton... of the annual rent to John Mounte of Bolton, landlord thereof of 7/- and to her Majesty 12d... TO HAVE AND TO HOLD to the use of the said Richard Eccleston... forever... as by the deed of sale thereof dated 3rd February 1602 appears... NOW John Mounte in consideration of £3/6/8 paid by Richard Eccleston in the name of a fine and gressome for and touching the said messuage etc... he quitclaims all rights to the property... YIELDING and paying to the Queen the rent of 12d and to him, John Mounte, the yearly rent of 13/-.

Indenture made 11th December 1609 BETWEEN George Fell the elder, John Benson and William Kilner of Ulveston, in the county of Lancaster, yeoman, of the one part, and William Brockbank of Ulveston, carpenter, of the other part... WITNESSETH that whereas King James by letters patent on 26th November 7 James I granted to George Salter of the parish of St Dunstan in the west of London, gentleman, and John Williams of the parish of St Peter le Pore, London, draper, and their heirs forever, the manor of Nevilhall... in Ulveston...known by the name of Newhale... to hold of his Majesty’s manor of East Greenwich, in the county of Kent, by fealty only, in free and common socage, and not in capite, nor by knight’s service... AND WHEREAS ALSO THE SAID George Salter and John Williams in and by an indenture of Bargain and Sale enrolled in the high court of Chancery and dated 22nd October 8 James I... DID grant, bargain and sell etc unto George Fell, John Benson and William Kilner forever all the said manor of Newhale...forever... NOW THIS INDENTURE WITNESSETH that they have conveyed the same to William Brockbank, his heirs and assigns forever... ALL that close or parcel of ground lying and being in Mowhide Common called the Inludam Close, containing by estimation 2 ½ acres, and of the annual rent of 2/-, parcel of the manor of Newhale, and now in the holding of the said William Brockbank.

CARTMELL - 1614
BARGAIN and SALE with FEOFMENT
Bargain and Sale with feofment made in 1614 by Thomas Willson of Flookburgh, in the county of Lancaster, carpenter, in consideration of £7/13/4 to Richard Symsonn, son of John Symsonn of Nethercarke, in the parish of Cartmell in the said county, yeoman... of ALL that dale or parcel of land arable lying between a dale of John Sy on the north, and one dale in the tenure of George Killner on the south called Robinhawe, containing by estimation ½ acre of arable land (adjoining the parcel of land held by Rowland Millner) and which Rowland Millner by charter made to Thomas Wilson sold him the land... TO HAVE AND TO HOLD the said dale etc in perpetuity to Richard Symsonn of the chief lords of the fee.

Gardner of Banckend in Muchurswick, in the county aforesaid, yeoman,
of all her right interest title etc... in all that messuage , tenement and
farmhold lying in Flookburgh, in the county of Lancaster, late in the possession
and occupation of William Caton, now in the possession of
Richard Egglestow... and also all such estate
and interest that the said Ann her heirs or assigns may have
or hereafter may challenge... in or out of one other messuage and tenement,
being in Ulverston, in the county of Lancaster, now in the possession or occuation
of Richard Nubye of Ulverston... TO HAVE AND TO HOLD to William
Caton forever...AND further Arthur Gardner
was constituted her true and lawful attorney... to deliver peaceable possession

BARGAIN and SALE with FEOFMENT - 1615
Bargain and Sale with Feofment by Richard Fell of Birckbye in Cartmell, in the county of Lancaster, yeoman, that in performance of covenants contained in an indenture made with Agnes Roskell, daughter of Robert Roskell, in which he confirms to Robert Roskell and his heirs all that messuage and all lands lying in Birckbie in Cartmell ... TO HAVE AND TO HOLD... forever. Dated in 1615.

CONFIRMATION OF GRANT with QUITCLAIM - 1617
By Richard Fell of Trinkett in Furness, in the county of Lancaster, yeoman, and Jane his wife, who in consideration of £76/13/4 granted to Christopher Fell of Trinckett , brother of Richard Fell, webster, being a quitclaim and confirmation of grant with the license of the worshipful Joseph Penyngton of Munchaster, squire, Lord of the premises, of ALL those four closes commonly called the two four closes and the two eight acres and being by estimation 10 acres together, with all the housing now in the possession of the said Richard Fell, within the fould yeate with the east end of the barn to the middle thereof, with the little grass garth and a little cowgarth with all the fronts so far as the said housing doth extend and as the same is now marked, and being of the annual rent to the said Joseph Pennington of 20/7... TO HAVE AND TO HOLD according to the custom of tenantright.... YIELDING and paying the abovesaid rent and all other duties, suits and services due for the same.

WILL 1620
Will dated 30th November 1620 of William Nubie of Nethergate in Cartmell. He gives to his son Richard all his messuage and tenement according to a pair of indentures made at the marriage of the said Richard, he paying out of the same to his son John and to Agnes his daughter the sum of £20 equally between them, to wit £13/6/8/ at or before Christmas day 1622, and the sum of £6/13/4 at the 2nd day of February 1622. He gives to John his son and Agnes his daughter all his mortgages, excepting of the same his wife’s profit. He gives to John Simpson his grandchild 20/-. He makes Agnes his wife and Richard Simpson his son in law executors of his will, they paying his death legacies and funeral expenses. James Finsthwaite, John Stainton and John Roskell are appointed supervisors.

Indenture made 1st July 1621 BETWEEN Walter Chamber of the Hawes, in the county of Westmoreland, gentleman, of the one part, and Robert Chamber of Nether Steveley, in the same county, son of Arthur Chamber late of Nether Staveley, of the other part...WITNESSETH that whereas Robert Chamber of Nether Staveley, grandfather of the said Robert Chamber party to these presents, doth hold, possess etc in tenantright according to the custom heretofore used, one messuage and tenement in Nether Staveley, and doth hold the same of the above named Walter Chamber the inheritor and landlord thereof, by payment of the yearly rent of 8/- and doing other duties and services according to the said custom... which said messuage Robert Chamber the younger hath bought of the said Walter Chamber...AND it is further intended by the parties hereto that the said Walter Chamber shall presently execute to the said Robert Chamber a sufficient estate of fee simple... TO HAVE AND TO HOLD forever.

ASSIGNMENT OF LEASE
Indenture dated 8th May 1623 by William Pearsh of Hyerleth, in the county of Lancaster, husbandman, in consideration of 40/-, to Richard Petty of Osmonderley in the said county, husbandman, of ALL that rood of arable ground in Arli----(?) called the okehawe or Pihill, between a dale of the said Richard Pettyes on the south, and a dale belonging to John Jackson on the north, parcel of his tenement in Osmonderley and now or late in the tenure or occupation of the said William Pearsh... TO HAVE AND TO HOLD... for a term of years heretofore granted and conveyed by the right Hon William Earl of Derby, yielding and paying therefore yearly one pepper corn.

Indenture made 28th April 1628 BETWEEN John Fleming of Conistone, in the county of Lancaster, esquire, of the one part, and Richard Brockbanke of Totlebanke in Suberthwait, in the said county, yeoman, and Richard Holme of the proutcragge in Blaweth , in the said county, waller, of the other part....WHEREAS our late sovereign Lord King James by his letters patent...dated 17th February 6 James I... granted and conveyed unto the said John Fleming and John Ambrose of Lowicke, in the said county, esquires, the rectory and parsonage of Ulverstone in Furness and all tythes of corn, grain, etc and all other tythes both great and small, as personal and real or mixed.... within the parish of Ulverston (except as in the Letters Patent excepted)... NOW THIS INDENTURE WITNESSETH that the said John Fleming (after division of the said tythes made between him and John Ambrose) in consideration of £3/14/0 HATH granted to Richard Brockbanke ALL the tythes etc and all the rents and yearly sums payable... and all other church dues and spiritual dues whatsoever... TO HAVE AND TO HOLD the moiety of the said tythes etc... YIELDING and paying therefore the annual rent of 20d.

Deed by Richard Ecleston of Flookburgh in Cartmell, in the county of Lancaster, yeoman, and Anne his wife... in consideration of £10 to John Simpson, youngest son and heir apparent of Richard Simpson the eldest, of Flookburgh, yeoman, of one messuage, tenement and burgage ,situated in Flookburgh, which he had lately bought of one John Maston and Margaret his wife, and now is in the quiet possession of the said Richard Ecleston, and of the freehold of William Garner, gentleman, and of the yearly rent of 7/-... and the yearly rent to is King’s Majesty of 12d... which contained by estimation 3 roods of arable land and meadow... TO HAVE AND TO HOLD unto the said John Simpson his heirs and assigns by title of tenant right forever, and after the death of the said Richard Ecleston unto Anne his wife forever, according to the ancient custom of the manor of Flookburgh.

MARRIAGE SETTLEMENT 1635
Indenture made 2nd February between John Thompsonne of the Greaves and Robert Thompsonne, natural son of the said John Thomsonne, of the same place, and in the county of Lancaster, husbandman, of the one part, and Rowland Turner of Woolerigg, William Grenewood of Backbarrow, husbandman, and Dorothy Grenewood, daughter of the said William, of the same place, spinster, of the other part... WITNESSETH that it is concluded and agreed... that the said Rowland Turner by the grace of God shall marry.... and take to his wife the said Dorothy Grenewood at or before the last day of this instant February, if she the said Dorothy will thereunto assent and agree, and the laws of holy church will permit and suffer it.... in like manner the said William Grenewood and Dorothy Grenewood covenant and promise to and with the said John Thompsonne and Robert Thompsonne that the said Dorothy Grenewood... IN CONSIDERATION of which said marriage so to be had she will, enjoy his messuage in Woolrigg, where he now dwells, and to the issue lawfully to be begotten....according to the custom of Cartmell.

Indenture made 2nd January 1636 BETWEEN Christopher Brockbanck of Howbarrowe in Cartmell, in the county of Lancaster, butcher, of the one part, and Richard Biglande of Holker in Cartmell, linen Webster, of the other part... WITNESSETH that Christopher Brockbanck HATH bargained, sold etc...unto the said Richard Biglande all those closes or closures of arable land, meadow, pasture and waste, containing by estimation 5 acres, lying and being at Howbarrowe, called by the names of the High Field, Long Dale and Crofte Meadow, late in the tenure and possession of the said William Brockbancke, father of the said Christopher, his heirs and assigns, and now in the possession of the said Christopher... TO HAVE AND TO HOLD all the said closes etc... to the said Richard Biglande his heirs and assigns forever...YIELDING and paying therefore for the tythe thereof three hoopes of Bigge yearly to the proctor of Cartmell and for free rent and haye 3d yearly.

Indenture made 13th February 1648 according to the computation of the Church of England...BETWEEN Agnes Braithwaite of Flookburgh in Cartmell, in the county of Lancaster, widow, of the one part, and William Braithwaite, her eldest son, of the same place and county, bachelor, on the other part... WITNESSETH that the said Agnes Braithwaite...chiefly for the natural love and affection which she bears to the said William Braithwaite her son and for his better preferment... HATH given granted aliened etc.. unto him and his heirs for ever ALL that her messuage and tenement, situated in Flookburgh, wherein the said Agnes and William do now live and inhabit of the yearly rent of 15/7... TO HAVE AND TO HOLD... the said messuage immediately after the decease of the said Agnes... according to the ancient customs of the manor of Cartmell... AND the said William Braithwaite for himself and his heirs and assigns doth covenant that the said Agnes his mother shall and may at all times hereafter during the term of her natural life quietly and peaceably have, hold and enjoy the said messuage.

Indenture made 10th November 1651 BETWEEN William Knipe of Broughton and Thomas Fletcher of Winder in Cartmell, in the county of Lancaster, gentleman, George Braithwaite of the Crainge, William Pepper of Nether Carke, and Thomas Kellett of the Felyeat, all within the parish of Cartmell, of the one part, and Edward (or Edmund) Casson of Nether Carke in Cartmell, yeoman, of the other part... WTINESSETH that whereas the late King Charles did by his letters patent, as well as under the great seal of England, as under the seals of the Duchy and County Palatine of Lancaster dated 1st July in the 16th year of his reign... give and grant unto the said William Knipe, Thomas Fletcher, George Braithwaite, William Pepper and Thomas Kellett, and to Rowland Briggs and Richard Simpson, since deceased, and to their heirs and assigns forever... ALL those his messuages, lands and territories situated in the prepositure or graveshippes of Cartmell and the several bailiwicks of Cartmell Fell and Staveley, Broughton, Walton and Barngarth, commonly called by the names of Windermoore, Lillidubbs, Templand Banke, Holkerbank, Backbarrowe Banke, Hampfell Banke, Cartmell Fell and Cartmell Cumons, situated and being in the manor of Cartmell... ALL which said messuages etc to have been part and parcel of the manor of Cartmell... paying for the same to the late King Charles’s heirs and successors all the ancient yearly rents etc due and payable for the same... NOW THIS INDENTURE WITNESSETH that the said William Knipe et al... in consideration of £6/17/6...paid by Edward Casson to Sir William Elphinston and John Croft or to David Cunningham and Nimian Cunningham Gentleman... lawful attornies to the said Sir William Elphiston and John Croft to receive the same... HAVE given, granted etc... the above premises, being of the yearly rent of 3/11, besides 2/1 for knowing to be paid every two and a half years... ALSO all that tenement or close of meadow near Nether Carke called the Meadow Close, of the yearly rent of 2/-, and also all that intack lying at Nether Carke, of the yearly rent of 4d... being now in the possession of the said Edward Casson and Margaret Newby, widow, or their assigns... Bargain and Sale with Feofment by Thomas Burnes of Walton in Cartmell, in the county of Lancaster, in consideration of £9/12/0 to William Slatter of Walton, coverlet weaver... of ALL that parcel of meadow lying and being in that close of land called Coutterland at the nether end the west, along the broakesyde, containing 1 rood, already marked forth and also 1 parcel of meadow lying and being in the said close of land at the upend of the said close at the broakesyde, containing by estimation ½ rood, as it lyeth already marked and set forth... TO HAVE AND TO HOLD unto the said William Slatter his heirs and assigns for ever... yielding and paying therefore the annual rent of 6d always upon Michaelmas day upon lawful demand.

Assignment of a lease by George Dodshon of Newbiggin in Osmunderley, in the county of Lancaster, in consideration of £30 to Henry Townsend of Newbigging, husbandman, of all his estate, right and title in any dales or several parcels of arable ground, meadow or pasture, situated in the north side of one close commonly called ‘ye Infield to ye middle of ye said close’... part and parcel of my messuage tenement and farm held at Newbigging, within the precincts of the liberties of Osmunderley, containing by estimation 9 rods... TO HAVE AND TO HOLD for the term of 1000 years from the Right Honble William Earl of Derby, yielding and paying to the said earl an annual rent of 1d.

WITNESSETH that the said Rowland Wilson in consideration of £60... HATH given, granted etc unto the said Robert Wilson ALL that one messuage, house or tenement, one barn, outhouses, one orchard, garden, one close adjoining to the said house commonly called the close above the house, one other close called Longstorke, one other close called Turner Well Parrocke, one other close called Corneparrock, all that one loane and wood or trees growing therein, leading from Rogerkidding to the faryeat, and also all the mosse and turbary belonging to the said Rowland Wilson lying in Rusland Mosse... TO HAVE AND TO HOLD unto the said Robert Wilson his heirs and assigns forever... paying therefore yearly the annual rent of three pence for Bloomesmithy rent at days accustomed.

Indenture dated 28th May 1684 BETWEEN Robert Atkinson of Crosslands in Furness Fells, in the county of Lancaster, yeoman, of the one part, and Robert Wilson of Roger Kiddinge in the said Furness, yeoman, of the other part... WITNESSETH that whereas John Bell and Jane his wife, William Pepper and Jemett his wife, Rowland Wilson and Dennis his wife, did at the last assize held for the county of Lancaster in due form... levy a fine... of 2 messuages, 2 barns, 2 gardens, 2 orchards, 20 acres of land, 6 acres of meadow, 6 acres of pasture, 6 acres of moss and common of pasture for all cattle... in Sawrey Salterthwaite and Roger Kiddinge, to the said Robert Atkinson and his heirs forever... being lately purchased of Rowland Wilson of Roger Kiddinge... NOW it is and was at the time of levying the fine intended... this should be to the only use and behoof of Robert Wilson his heirs and assigns forever... and accordingly the said Robert Atkinson HATH remised released etc unto Robert Wilson his heirs and assigns forever ALL the said messuage... YIELDING and paying 3d yearly unto the chief lords of the fee. Dated 11th May 1695.

PROBATE COPY OF WILL
Probate copy of the will of Edward Killner of Haslerigg in Cartmell, in the county of Lancaster, yeoman. He gave his wife Elizabeth all his messuage, tenements, lands and grounds thereto belonging at Haslerigg, until such time as Edward Killner his son attains his full age of 24 years, when he will be given the aforementioned. He is charged to pay £40 to Agnes, Mary, Elizabeth, Sarah and George Killner his brother and sisters, to be divided between them equally. £20 are to be paid when he enters the premises, and the remaining £20 when he attains the age of 26 years. The younger children are to receive maintenance out of the lands from his entry therein until their age of 16 years, and if any of them happen to die, their share to be divided among the survivors. He wishes his wood (excepting Ashes), standing and growing in the field on the back of his house, and the portion adjoining, to Elizabeth his wife, she selling the same to such persons as will give the most money for the same by the first opportunity after his death, the money raised by such a sale to be used towards advancing his younger children. He gives to Edward his son 40/- towards setting him up in his trade, and also the table in the house and wood to make his stools. To George his younger son he gives £5 now in Mary French’s hands, and the interest thereon when he attains the age of 21 years. The remainder of his personal goods and estate undisposed he gives to Elizabeth his wife and his younger children. He nominates Elizabeth his wife the guardian of his children until they attain the age of 21 years. He appoints Henry Beck of Fairidge, Edward Walker of Newyear and Thomas Barrow of Hill, all in Cartmell, yeomen, supervisors of his will, and he gives them each 2/- as a token of his love for them. Indenture dated 23rd April 1778 BETWEEN James Ormandy of Beckside in Mansriggs in the parish of Ulveston, in the county of Lancaster, yeoman, of the one part, and William Ormandy of the same place, yeoman, and Sarah his wife, father and mother of the said James Ormandy of the other part... WHEREAS by one indenture dated the day of these presents made between the said William Ormandy of the one part, and the said James Ormandy of the other part... the said William Ormandy in consideration of an annuity of £12 to be paid to him or his assigns during the joint lives of him the said William Ormandy and Sarah his wife, and after the decease of either of them, the annuity of £6 to be paid to the survivor of them or the assigns during the life of such survivor and for other consideration therein mentioned... they DID grant bargain, set, transfer and set over unto the said James Ormandy the son... all the leasehold messuage and tenement, houses , lands, closes etc... situated at Newbigging in Osmortherley, and also two parcels of moss or turbary ground sitauted in Hollow Mire Moss... TO HAVE AND TO HOLD to the said James Ormandy... during the remainder of the term of 1000 years unexpired... and also by the other Indenture of the same date and for the consideration therein mentioned... DID grant bargain sell and convey to the said James Ormandy, his heirs and assigns certain freehold closes, situated in the said Mansrigg called Knivers Higfield, and waste to hold to the same James Ormandy, his heirs and assigns forever, as in and by the said part recited indentures may and doth fully appear... AND WHEREAS at the time of the execution of the said two indentures it was agreed by the said parties that the above mentioned annuities should be secured to the said William Ormandy and Sarah his wife by a grant or rent charge on all the before mentioned premises and to be raised and paid out of the same...
